When families first hire a nanny, guaranteed hours can sometimes feel confusing. But in the nanny industry, guaranteed hours are considered a standard employment practice because they create consistency and stability for both the nanny and the family.

At its core, guaranteed hours means a nanny is paid because they kept their schedule available for the family, even if the family ends up not needing care during some of those hours.

What Are Guaranteed Hours?

Guaranteed hours are a set number of paid hours each week outlined in the work agreement.

For example, if a nanny is guaranteed 45 hours per week, she is paid for those 45 hours even if the family only uses 38 hours during a particular week.

Guaranteed hours commonly apply when:

  • A family takes a vacation without the nanny
  • Grandparents visit and want extra time with the children
  • Parents get home early and dismiss the nanny for the day
  • A parent unexpectedly takes the day off
  • Children attend camp, school events, or playdates during scheduled work hours
  • The family simply does not need coverage during normally scheduled hours

In these situations, the nanny still receives her guaranteed hours because she reserved that time for the family and was available to work.

Why Guaranteed Hours Matter

Unlike many hourly jobs, nannies cannot usually replace canceled hours with other work on short notice. Their schedule is usually committed to one family. Guaranteed hours provide a predictable income and, therefore, financial stability, clearer scheduling expectations, and a stronger working relationship built on consistency and trust. Offering guaranteed hours also helps families attract and retain experienced caregivers who are looking for stable, professional positions.

Guaranteed Hours Are Not “Banked” Hours

One common misunderstanding is the idea that unused hours can later be “made up.” Banking hours is not allowed. If a family chooses not to use scheduled hours during the week, those unused hours cannot be rolled over into future weeks. Likewise, all hours actually worked must always be paid. For example, if a nanny leaves early on Friday because the family no longer needs care, those hours cannot later be added onto another day to avoid additional pay.

What About Overtime?

Many nanny schedules regularly include overtime hours. For example, a nanny may normally work 45 hours per week, with 5 of those hours paid at the overtime rate of 1.5 times the regular hourly rate, as required under federal law. If the nanny only works 38 hours during a week because the family does not need care, overtime is not legally triggered because overtime applies to hours actually worked over 40 in a workweek. Because of this, families and nannies should decide ahead of time how guaranteed pay will be handled in these situations and clearly outline it in their work agreement.

Some families choose to:

  • continue paying the nanny their normal weekly amount, including the overtime differential, because their intent was to provide consistent income to their nanny,

while others choose to:

  • pay only the guaranteed straight-time hours when overtime was not actually worked.

Clear communication up front helps prevent confusion later.
